    Summary of Permit Application and Related Materials

    • For any projects that are expected to cost under $10,000, the Property Owner should fill out this webpage. This serves to alert our Construction Monitor to any activity at your property so that he knows he doesn't need to question any contractors seen working at your property.

    The Property Owner should complete and supply to the Building Committee the required permit fees, blueprints, surveys, schedule of completion etc as are detailed in section F of the Middlesex Beach Association Rules and Regulations for Construction document. This includes a statement to be signed by both the Property Owner and Primary Contractor that they have read, understood and agree to abide by the Restrictive Covenants, and the procedures outlined in the Middlesex Beach Association Rules and Regulations for Construction.

    • For all projects of $10,000 or over, the Property Owner must submit a construction bond of 5% of estimated construction cost along with all of the application documents. The check will be deposited within 5 business days after the Building Permit has been issued.

    • The Building Committee will accept or deny all applications within 30 days of receipt of all of the above items. If denied, the Building Committee will provide reasons for so doing and suggestions for remedies, if feasible. Note that the Building Committee may not deny an application on merely aesthetic grounds.

    • Once any application has been approved, the Property Owner will be issued a Building Permit signed by a committee member.  Please note that any work which is started without a valid Middlesex Building permit will result in fines of $100 per day.

    • Along with the laminated Building Permit will be a laminated Allowable Hours of Construction poster clearly stating allowable days and times of exterior and interior construction. Both of these must be prominently displayed on the construction site until such time as the project is completed. Both of these must be posted so as to be viewable by any community member without venturing too far onto the potentially-hazardous construction site.

    • No work will commence until all parties have signed and dated the Permit and it has been posted on the property where the work will be performed.

    • The Property Owner is responsible for the performance of all Contractors and subcontractors in regard to the Restrictive Covenants. The construction bond may be forfeited in whole or in part for any violations of the Middlesex Beach Association Restrictive Covenants.

    • In accordance with building requirements adopted by the Board in 2001, the Building Permit will include the property address, name of the property Owner, name and contact phone number of the Primary Contractor, and estimated completion date.

    • Upon completion of a project, the property owner must return the Building Permit and notify the Building Committee in writing that the project is completed. If a Construction Bond was posted the owner must submit a copy of the Sussex County Occupancy Permit, a copy of the Certificate of Elevation, and a written request to the Middlesex Beach Building Committee for final review of the project by a member of the Building Committee. After satisfactory inspection by the Building Committee, the Bond will be returned minus any amount forfeited for violations of the restrictions. The bond funds will be returned within 30 days of receipt of the request if there are no outstanding issues to be resolved.

    • Construction must start within 1 year from the date the permit was signed by the Building Committee. Otherwise, the permit shall be declared null and void and the permit fees are forfeited.
